  • Czech Civil Code (Občanský zákoník, Law No. 89/2012 Coll., Sections 1933-1953 on short-term lease)

  • GDPR (Regulation (EU) 2016/679)
  • Czech Act on Business Conditions and Protection of Consumer Interests (Law No. 634/1992 Coll.)

1. Acceptance of Terms

By accessing and using the Velenice Cottage website and booking accommodations, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

If you do not agree to these terms, you may not book or use our accommodations. We reserve the right to modify these terms at any time. Changes become effective immediately upon posting.

2. Booking and Reservation

2.1 How to Book

Reservations are made through our website booking form. To book, you must:

  • Provide accurate personal information (name, email, phone number)
  • Specify your desired check-in and check-out dates
  • Select the cottage spaces you wish to book
  • Review and accept these terms and conditions
  • Provide valid payment information

2.2 Booking Confirmation

After submitting your booking request, you will receive a confirmation email at the address provided. This confirmation is your receipt and proof of booking. Please save this email for your records.

Your reservation is confirmed only after payment is processed successfully. Pending reservations will be held for a maximum of 24 hours before being cancelled if payment is not received.

2.3 Availability and Accuracy

We make every effort to ensure that availability information and pricing displayed on our website is accurate. However, we do not guarantee the accuracy of online information. Errors can occur, and we reserve the right to cancel bookings that resulted from pricing or availability errors beyond our control.

3. Pricing and Payment

Holiday Dates Include: Christmas (Dec 20-Jan 2), New Year, Easter period, summer holiday peak (mid-July to mid-August), and other Czech national holidays.

3.1 Price Components

The total price for your stay includes:

  • Accommodation for the number of nights specified
  • Use of cottage facilities (kitchen, bathroom, living areas)
  • Utilities (heating, electricity, water, WiFi)
  • Cleaning fee (one-time charge per stay, not per night)
  • All local taxes and VAT

3.2 Payment Methods

We accept payment by:

  • Credit card (Visa, Mastercard)
  • Bank transfer (details provided after booking)
  • Direct arrangement with owners

Payment is due in full at the time of booking unless otherwise arranged. All prices are in Euros (€) and include Czech VAT (21%).

3.3 Price Changes

Prices are subject to change without notice. However, once your booking is confirmed and payment is received, your rate is locked and will not increase.

4. Cancellation Policy

4.1 Cancellation Terms

4.2 How to Cancel

To cancel your booking, send an email to info@velenice.netwrks.cloud with your booking confirmation number. The cancellation is effective on the date we receive and confirm your cancellation request.

4.3 Extenuating Circumstances

We understand that sometimes situations beyond your control require cancellation. In cases of genuine hardship (serious illness, family emergency, government travel restrictions), please contact us to discuss alternative arrangements:

  • Date rescheduling (with availability)
  • Alternative accommodation
  • Partial refund consideration

Requests for exceptions must be submitted within 48 hours of cancellation with supporting documentation (medical certificate, government order, etc.). We will respond within 5 business days.

4.4 No-Show Policy

If you do not arrive for your booking without prior notice or cancellation, you forfeit the entire payment. This is considered a "no-show" and the full amount is retained.

5. Check-In and Check-Out

5.1 Check-In Procedure

Check-In Time: 3:00 PM (15:00)
Check-Out Time: 10:00 AM (10:00)

Early check-in and late check-out are subject to availability and must be arranged in advance via email at least 24 hours before your arrival. Additional charges may apply:

  • Early check-in (before 3 PM): €20-30 per hour or part thereof
  • Late check-out (after 10 AM): €20-30 per hour or part thereof

5.2 Access and Keys

Key pickup instructions will be provided in your confirmation email. You are responsible for:

  • Safekeeping of keys during your stay
  • Returning all keys at check-out
  • Reporting any lost keys immediately

Loss of keys will result in a lock replacement charge (approximately €150-200) added to your bill.

5.3 Guest Information

You must provide accurate information for all guests staying at the cottage. The person making the booking is responsible for the conduct and compliance of all guests with these terms.

6. House Rules and Guest Conduct

6.1 Occupancy Limits

Each cottage space has a maximum occupancy limit specified in the booking details. Exceeding this limit is prohibited and may result in immediate eviction without refund.

6.2 Quiet Hours

To respect the peaceful countryside environment and other guests:

  • Quiet hours are 10:00 PM to 8:00 AM
  • Music, television, and outdoor activities should be kept at reasonable levels
  • Loud parties and excessive noise are strictly prohibited

6.3 Smoking and Alcohol

Smoking: The cottage is a non-smoking facility. Smoking is prohibited inside all buildings. Smoking is permitted only in designated outdoor areas, and you must dispose of cigarette butts responsibly.

Violation of smoking rules will result in a €200-300 deep cleaning charge.

Alcohol: Guests may bring and consume alcohol responsibly on the property. Intoxication that disturbs other guests or endangers safety may result in eviction.

6.4 Pets and Animals

Pets are not permitted inside the cottage without prior written approval. Service animals are exempt. Unauthorized pets will result in immediate removal and a €300 cleaning fee.

6.5 Prohibited Activities

The following activities are strictly prohibited:

  • Commercial filming, photography, or events without permission
  • Holding parties, gatherings, or events larger than occupancy limits
  • Creating excessive noise or disturbance
  • Damaging property or fixtures
  • Illegal activity of any kind
  • Harassment or disruptive behavior toward staff or other guests
  • Posting identifying photos or information online without permission

6.6 Damages and Breakage

You are responsible for any damage to the cottage or furnishings caused by you or your guests during your stay. Normal wear and tear is not considered damage. Charges for damage will be deducted from your security deposit or charged to your payment method.

Examples of damages with typical replacement costs:

  • Broken window: €150-400
  • Damaged door: €200-600
  • Broken furniture: €100-500
  • Stained mattress/upholstery: €300-800
  • Broken appliances: €300-1500

You will be informed of any damage charges within 7 days of checkout. Invoices and photos will be provided upon request.

7. Liability and Disclaimers

7.1 Liability Limitations

Velenice Cottage is not responsible for:

  • Loss, theft, or damage to your personal belongings
  • Injury or illness during your stay (unless caused by our negligence)
  • Disruptions due to weather, natural disasters, or acts of God
  • Utility interruptions (water, electricity, heating)
  • WiFi outages or internet connectivity issues
  • Noise or disturbance from neighboring properties
  • Injury to or loss of your animals (not permitted)

7.2 Indemnification

You agree to indemnify and hold harmless Velenice Cottage, its owners (Petra and Libor Ballaty), employees, and agents from any claims, damages, or expenses arising from:

  • Your violation of these terms
  • Your injury or damage caused by your actions
  • Your negligence or misconduct
  • Your breach of applicable laws

7.3 Assumption of Risk

By booking and staying at Velenice Cottage, you assume all risks associated with the accommodation and activities in the surrounding area. We recommend obtaining travel insurance that covers cancellations and health emergencies.

8. Dispute Resolution

8.1 Informal Resolution

In the event of a dispute, we encourage you to contact us first at info@velenice.netwrks.cloud to resolve the matter informally. Most issues can be resolved through direct communication within 7-10 days.

8.2 Mediation

If informal resolution is unsuccessful, either party may request mediation through a Czech mediator or arbitrator. The costs and procedures will be determined by mutual agreement.

8.3 Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Czech Republic, specifically the Czech Civil Code (Law No. 89/2012 Coll.). Any legal proceedings arising from these terms shall be brought exclusively in the Czech courts having territorial jurisdiction over the location of the cottage.

Competent Court: District Court for Benešov (Krajský soud pro Českou republiku - Benešovský okres), which has jurisdiction over Velenice (postal code 28901) in the Central Bohemia Region. In consumer disputes, the District Court for Benešov retains jurisdiction pursuant to Czech Civil Code Article 86a.

8.4 Consumer Rights

If you are a consumer (booking for personal purposes, not commercial), you have additional protections under Czech law. Consumer complaints can be filed with:

9. Force Majeure

In the event of unforeseeable circumstances beyond our control (war, terrorism, natural disaster, pandemic, government order), we may cancel or modify your reservation. In such cases:

  • We will offer a full refund or alternative dates
  • We will notify you as soon as possible
  • We will not be liable for any additional costs or damages

10. Privacy and Data Protection

Your personal information will be handled according to our Privacy Policy. Please review our Privacy Policy for details on how we collect, use, and protect your data.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the website and accommodation constitutes acceptance of the modified terms.

We will make efforts to notify guests of significant changes via email, but it is your responsibility to review these terms regularly.
